Spill Da Beans Terms of Service

These Terms are an agreement between you and Spill Da Beans (“we”, “us”), the operator of the app, and govern your use of it. By creating an account or using the app you agree to them. If you don’t agree, please don’t use Spill Da Beans.

1. What Spill Da Beans is

Spill Da Beans is an iOS app for recommending places to your friends. You “spill a bean” to recommend a place: you choose the place and can add a photo, a short note (up to 280 characters) and quick tags. Beans are positive recommendations only; the app has no ratings. Your friends in the app are your “Pod.” Your beans are shared with your Pod. You can see your Pod’s beans in a feed and on a map of nearby places, and you can report a bean or block another user.

2. Who can use Spill Da Beans

You must be at least 13 years old. If you are between 13 and the age of majority in your jurisdiction, you must have permission from a parent or guardian. You must also comply with the laws that apply to you.

3. Your account

When you sign up with Sign in with Apple, your phone number or your email address, you agree to:

  • provide accurate information
  • keep your sign-in credentials and device secure
  • be responsible for activity that happens on your account

You can delete your account at any time in the app from Settings, then Delete Account. Deletion is permanent and removes your profile, beans and their photos, contact codes and sign-in record. Your photos also stop being used as place pictures (see Your content). We also retain the deletion and moderation records described in our Privacy Policy.

4. Your content

You own the photos and text you post to Spill Da Beans. By spilling a bean you grant us a limited, non-exclusive, royalty-free license to host, display, and distribute that content within the app to your Pod. For photos, the license also lets us use the photo as a picture of the place it was taken at, shown to all users of the app, and to keep showing it there after you delete the bean, until a newer photo replaces it or you delete your account. This permission to use a place picture does not include adding your note, tags or attribution as the bean’s author to that picture. Your bean is shown to your Pod; your profile information is also available to other signed-in users. Otherwise the license ends when you delete the bean or your account. You can ask us to remove a place picture you took by emailing support@spilldabeans.com.

You are responsible for the content you post. Do not post anything that:

  • you don’t have the right to share
  • infringes someone else’s copyright, trademark, or other rights
  • is sexually explicit or pornographic, contains nudity of any kind, or sexualizes minors in any way
  • is an intimate or sexual image or video of any person shared without their consent, including images that are AI-generated, synthetic or digitally altered (“deepfakes”)
  • is hateful or discriminatory, including hate speech targeting people for their race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability or other protected characteristic
  • harasses, bullies, threatens, intimidates, stalks or doxxes another person, or shares someone’s private information without their permission
  • depicts or encourages violence, self-harm or dangerous acts, or is gratuitously graphic
  • depicts or promotes illegal activity, including illegal drugs or weapons
  • is false or misleading in a way that could harm others, or impersonates someone
  • contains malware or links to malicious sites
  • is spam or unsolicited promotional content
  • is otherwise objectionable or prohibited by Apple’s App Store guidelines

We have zero tolerance for objectionable content and abusive users. We remove content that violates these Terms and remove users who post it or abuse others from Spill Da Beans. We may use automated tools to detect content that breaks these rules, and we preserve evidence where the law requires.

You can report a bean or block another user from the bean’s menu. To report a user’s profile or profile photo, email support@spilldabeans.com. Reported beans are hidden while we review them, and we review reports of content that breaks these rules within 24 hours. Blocking someone removes them from your Pod, and neither of you will see the other’s beans.

5. Acceptable use

When using Spill Da Beans, do not:

  • attempt to access another user’s account or data
  • attempt to break, probe, or interfere with our infrastructure
  • scrape the app or its API
  • impersonate another person
  • use Spill Da Beans to violate any law

6. Service availability and changes

Spill Da Beans is provided “as is.” We do our best to keep the app available, but we don’t guarantee uptime or that any specific feature will continue to exist. We may add, remove, or change features as the app evolves. We will notify you of material changes in-app or via the contact you provided.

7. Termination

You can stop using Spill Da Beans at any time. You can delete your account from inside the app.

We will suspend or terminate your account if you post objectionable content or abuse other users, and we may do so for any other violation of these Terms, including any acceptable-use rule above, or if required by law. If your account is terminated, sections of these Terms that by their nature should survive termination (ownership, limitations of liability, disputes) will remain in effect.

8. Disclaimers

Spill Da Beans and all features are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the app will be uninterrupted, error-free, or that data will never be lost.

9. Limitation of liability

To the maximum extent permitted by law, Spill Da Beans and its operators will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits or data, arising out of or related to your use of the app. Our total liability for any claim related to Spill Da Beans will not exceed USD $100.

Some jurisdictions do not allow these limitations; in that case the limitations apply to the maximum extent permitted by law.

10. Apple-specific terms

If you obtained Spill Da Beans from Apple’s App Store, your use is also subject to Apple’s Licensed Application End User License Agreement. Apple is not a party to these Terms and is not responsible for Spill Da Beans or its content. Apple has no obligation to provide support for Spill Da Beans. Apple is a third-party beneficiary of these Terms and may enforce them against you.

11. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in California, and you consent to that jurisdiction.

12. Changes to these Terms

If we make material changes, we will update the “Last updated” date above and notify you in-app before the changes take effect. Continued use of Spill Da Beans after a change means you accept the updated Terms.
